These Terms of Use (“Terms”) govern your use of smarthouzz.com (the “Site”), operated by SmartHouzz (“SmartHouzz,” “we,” “us”). By using the Site, requesting a consultation or submitting a business listing, you agree to these Terms. If you do not agree, please do not use the Site.

1. Information only

Content on the Site, including product recommendations, prices, comparisons and guides, is general information. It is not professional, engineering, electrical, legal or financial advice. Product details and prices change often; always confirm them with the retailer or manufacturer. Electrical and low-voltage work should be done by a qualified, licensed professional where required by law.

2. Product links and third-party sites

The Site links to retailers, manufacturers and other websites we do not own or control. Purchases are made directly with those sellers under their terms, and we are not responsible for their products, pricing, shipping, returns or warranties. Some links are affiliate links; see our Affiliate Disclosure.

3. Installers, dealers and consultations

• Professionals listed on the Site and pros we connect you with are independent businesses. They are not employees, agents or partners of SmartHouzz.
• We do not guarantee the quality, timeliness, licensing, insurance or pricing of any professional’s work. Before hiring anyone, check their license, insurance, references and written contract.
• Any agreement for services is solely between you and the professional. SmartHouzz is not a party to it and is not responsible for disputes that arise.
• When you request a consultation, you agree that we may share your request with one or more professionals so they can contact you, as described in our Privacy Policy.

4. Business listings

If you submit a business listing, you agree that:

• The information you provide is accurate and kept up to date, and you are authorized to list the business.
• You hold any licenses, certifications and insurance you claim, and you will provide proof if we ask.
• You own or have permission to use the logos, photos and text you upload, and you grant SmartHouzz a non-exclusive, royalty-free license to display them on the Site and in promoting the Site.
• We may review, edit, decline, suspend or remove any listing at our discretion, including listings that are inaccurate, misleading or receive credible complaints.
• Fees for paid or featured listings and referral fees, if any, are governed by the separate terms presented when you sign up.

5. Acceptable use

You agree not to misuse the Site, including by submitting false or spam requests, scraping or copying content in bulk, interfering with the Site’s operation or security, or using the Site for any unlawful purpose.

6. Our content

The Site’s text, design, graphics and photos are owned by or licensed to SmartHouzz and are protected by copyright and other laws. You may view and share links to our pages for personal, non-commercial use. Product names and brands belong to their respective owners, and their mention does not imply endorsement.

7. Disclaimers

The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.

8. Limitation of liability

To the fullest extent permitted by law, SmartHouzz will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from products you buy or services you hire through links or connections made on the Site. Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars ($100).

9. Indemnity

You agree to indemnify and hold SmartHouzz harmless from claims, losses and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site, your listing content or your violation of these Terms.

10. Governing law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Palm Beach County, Florida.

11. Changes

We may update these Terms from time to time by posting a new version on this page with a new effective date. Continued use of the Site after a change means you accept the updated Terms.
